Terms of Service

These terms are a contract between you and the operator of The Beer App ("we", "us"). By creating an account or using The Beer App (the "Service") you agree to them. If you do not agree, do not use the Service.
1. Who may use it
You must be of legal drinking age in the country you are in, and at least 18 in any case: that is 19 in Canada and 21 in the United States. Where the age differs by province or state, we apply the highest. We ask for your country and your date of birth when you sign up, apply the stricter of the country you give and the one your phone is set to, and refuse accounts that are under age. The Service is not offered in countries where alcohol is prohibited. Giving a false date of birth or country is a breach of these terms and we will close the account. You must also have the legal capacity to enter into this contract, and you must not be barred from using the Service under the laws of your country.
We offer the Service only in the countries where the app is listed in the App Store, and may limit or withdraw it anywhere to comply with local law.
2. What the Service is, and is not
The Service lets you record and share photographs of drinks, see what other people are drinking, and take part in daily contests among your friends. It is for entertainment.
It is not advice of any kind. Nothing in it is medical advice, and nothing in it should be read as encouragement to drink. We do not sell, serve or supply alcohol, we are not a retailer, and we have no relationship with the venues that appear on the map beyond the fact that someone named them in a post.
3. Alcohol: your responsibility
You alone decide whether, what and how much you drink. You acknowledge that drinking alcohol carries risks — to your health, your judgement and your safety — and that you accept those risks yourself.
You agree that you will not drink and drive, will not use the Service while driving, and will not use it to encourage anyone to drink who is under age, pregnant, unwell, in recovery, or who has said they do not want to.
The Service has streaks and daily contests. They are a game about taking part; they are not a reason to drink. A day counts whether the glass is finished or not, and if any of it stops being fun there are people who will talk to you: see Drink Safely.
4. Your account
Keep your password to yourself; you are responsible for what happens under your account. Tell us promptly at support@thebeerapp.app if you think someone else has access to it. One person, one account. Do not impersonate anyone, and do not sell or transfer your account.
5. Your content, and the permission you give us
What you post stays yours. To run the Service we need permission to handle it, so you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, resize, transmit and display the content you post, solely in order to operate, maintain and improve the Service and to show it to the people you chose to show it to. That licence ends when you delete the content or your account, except for copies in routine backups that are overwritten on a rolling basis, for messages you sent (which stay with the people you sent them to), for content we keep to investigate a report, and where we must keep something to comply with the law.
We do not sell your content, and we do not licence it to anyone else for their own purposes. We will not use your photographs in advertising without asking you first.
You confirm that you own or have the right to post everything you upload, and that it does not infringe anyone's copyright, trade mark, privacy or other rights. If you photograph other people, that is on you: get their agreement before you post them.
6. What you may not do
- Post anything illegal, hateful, harassing, threatening, sexually explicit, violent, or that targets people for who they are.
- Post a nude or sexual image of anyone without their consent, including one that is faked or generated. We close the account that does.
- Post content that infringes someone else's rights — see Copyright & DMCA.
- Encourage under-age or dangerous drinking, drink-driving, or drinking games designed around excess.
- Spam, scam, phish, impersonate, or run a commercial promotion through the Service without our written agreement.
- Scrape, crawl, or bulk-collect other people's content or personal information; probe, disrupt, or attempt to gain unauthorised access to the Service; or work around any limit, rate or access control.
- Reverse-engineer the app except to the extent that the law says you may despite this restriction.

7. Moderation, reports and appeals
We do not screen content before it appears, and we are not obliged to monitor it. Automated filters check the text you submit for prohibited words and may stop it being posted; that is the only decision a machine makes, it can be wrong, and if you write to us a person will look at it. Every removal of something already posted, and every suspension, is decided by a person.
Reporting. You can report any post, comment, profile, group or message from inside the app, and block any user. Anyone, with or without an account, can also report content they believe is illegal by writing to support@thebeerapp.app with: where it is (a link, or the username and what it shows); why you believe it is illegal; your name and email address; and a statement that you believe in good faith that what you have told us is accurate and complete. You do not need to give your name if it is about the sexual abuse or exploitation of a child. We confirm we received it, and tell you what we decided and why.
What we do. We review reports and act on violations — usually within 24 hours — by removing content, restricting features, or suspending or closing accounts. We may act without notice where content is illegal or someone is at risk. Reports of intimate images shared without consent are dealt with within 48 hours at the most (see the Community Guidelines). Material that sexually exploits a child is preserved and reported to Cybertip.ca and, where the law requires, to the police; where we learn of a threat to someone’s life or safety, we tell the police.
Telling you, and appealing. If we remove something you posted or suspend your account, we email you what we did, which rule it broke, and that a person decided it — unless the law forbids us to tell you. If you think we got it wrong, reply to that email or write to support@thebeerapp.app within six months. A person will look at it again and tell you what they decide, and if we got it wrong we will put it back. It costs nothing and does not take away your right to go to court; in the European Union you may also take the dispute to an out-of-court dispute settlement body certified under the Digital Services Act.
Other complaints. You can also complain to us, at the same address, about how we handled a report, about our automated filters, or about anything else in how we keep the Service safe. We answer every one.
Contact point. support@thebeerapp.app is our single point of contact for users and for authorities, including under the EU Digital Services Act and the UK Online Safety Act. You can write to it in English or French, and a person reads everything that arrives.
8. Subscriptions, trials and refunds
The Service is currently free: no feature requires a subscription and nothing is charged. If we introduce paid subscriptions, we will update these terms and tell you before anything is charged, and the rest of this section will apply to them. Any free trial we offer will be available once per account and granted by us, not by the App Store.
Paid subscriptions on iOS are sold by Apple through your App Store account:
- Payment is charged to your App Store account at confirmation of purchase.
- Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period, at the price of the plan you chose.
- You can manage or cancel your subscription in your device's Settings → your name → Subscriptions. Deleting the app does not cancel it.
- Any unused part of a free trial is forfeited when you buy a subscription.
Refunds are handled by Apple, not by us, under the App Store's terms; we cannot issue them. Prices are shown in your own currency before you agree to anything and may change, with any change applying to periods after we tell you.
9. Ending it
You can stop at any time: delete your account from Settings, which removes your profile, posts, comments and uploaded photographs. Messages you sent stay with the people you sent them to, and content under a safety report may be preserved, as our Privacy Policy explains. Deleting your account does not cancel an App Store subscription — do that separately.
We may suspend or terminate your access if you breach these terms, if we are required to by law, or if continuing would expose us or other users to liability or harm. Where it is reasonable to do so, we will tell you why.
10. The Service is provided as it is
We work to keep the Service running and accurate, but we do not promise that it will be uninterrupted, error-free, or that anything in it is accurate — including venue details, beer information and rankings, which come from users. To the fullest extent the law allows, the Service is provided "as is" and "as available", and we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
We are not responsible for what other users do, on the Service or away from it, including anything that happens at a venue you found here.
11. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising out of your use of the Service — whatever the legal theory, and even if we were told such damages were possible.
To the fullest extent the law allows, our total liability to you for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) CAD $100.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited — including for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you, and you may have rights under consumer law that these terms cannot take away.
12. Indemnity
You agree to indemnify and hold harmless the operator of The Beer App and its people from claims, damages, losses and reasonable legal costs arising out of content you posted, your use of the Service, or your breach of these terms or of the law. This does not apply to the extent the claim arises from our own breach or negligence, and we will tell you promptly of any claim and not settle it in a way that admits fault on your behalf without asking you.
13. Disputes
Most problems are solved by writing to support@thebeerapp.app, and we ask that you try that first: tell us the problem and give us 30 days to put it right.
These terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law rules, and you and we submit to the exclusive jurisdiction of its courts — except that nothing stops either of us seeking an injunction where one is needed, and except that if you are a consumer resident elsewhere, you keep the benefit of any mandatory protections and the right to bring proceedings in the courts of the country you live in.
14. Apple
If you obtained the app from the App Store: this agreement is between you and us, not with Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide support or maintenance for it. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to the app, including product liability, legal or regulatory non-compliance, or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.
15. Changes to these terms
We may change these terms. If a change is material we will tell you inside the app or by email before it takes effect, and the date at the top of this page will change. Continuing to use the Service after that means you accept the new terms; if you do not, delete your account.
16. The rest
These terms, together with the Privacy Policy, Community Guidelines and Copyright policy, are the whole agreement between us about the Service. If any part of them is held unenforceable, the rest stands. Our not enforcing something is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours to a successor of the business, on notice to you. Nothing here creates a partnership or agency between us.
